Terms & Conditions

1 - Ordering and costs
You may place an order by using our automated telephone ordering service or through our text ordering service. The cost for these services is noted on each ordering page of our website. If payment is not received for an item purchased from the website, we reserve the right to seek payment, without notice, for up to 6 months after the date of ordering.

2 - Delivery times
Products ordered by telephone or text are usually delivered in under one minute. Logos or ringtones may take up to 24 hours, usually due to temporary network problems. We cannot be held responsible for any delays caused by anything other than our server . including delays due to your mobile network not fowarding the content to your mobile, or you keeping your mobile switched off for more than 24 hours. We can however, upon request by email, send the content again once more without additional charge.

3 - Cancellation of orders and refunds

Your order can be cancelled if the product has not been delivered. You will be refunded the cost of the telephone call or SMS.

Refunds will only be issued if you notify us within 7 days of ordering that you have not received your order. If you notify us outside of this period, there will be a minimum £1.50 administration fee charged to receive your refund.

If the product has been delivered*, it is deemed to be accepted and no cancellation of the order can take place, except in the case of a delivered product being completely different from the product ordered.

Each product has a free preview (sound or image) on our website. However, in using our service, you accept that the product may differ slightly from the preview on our website due to the different technical characteristics of each mobile with regards to industry standards, mobile sound quality and mobile display quality.

*A successful delivery is deemed to be:
. any order showed as dispatched on our systems
. any order that has arrived on a customer.s mobile phone
No refunds can be given, at any point, for any product requested and successfully delivered to your specifications.

No refunds can be given if your mobile or network is not compatible with our products. It is up to the user to check the compatibility list linked to each ordering page of our website before ordering a product.

No refunds can be given if you enter incorrect information when ordering by text or by phone, therefore please ensure you enter data carefully.

If at any time, you enter the incorrect information when ordering, or you are completely dissatisfied with the product, we can offer you a suitable replacement product.

If you order the same item twice, you may request a replacement product.

We will not be liable for any costs should an item be ordered without the bill payer.s permission. The bill payer has the right to recover costs against the abuser and we will support the bill payer to the fullest extent of the law.

We will not be liable for any costs should an item be ordered by a child under 16 years of age. It is clearly stated on each ordering page that children under 16 years of age cannot use our service. It is not possible for us to verify the age of a mobile number owner.

As it is not technically possible to put money back on mobile credit, REFUNDS ARE DELIVERED ONLY VIA PAYPAL (http://www.paypal.com)

4 - Intellectual Property
If you believe that a picture message, operator logo, image or other product belongs to you, or is a trademark or recognisable brand belonging to you, and you object to having that image on our website, you can request, in writing, that we withdraw the image. You must provide supportive evidence of copyright, trademark or brand mark for each image you wish to be removed.

5 - Complaints
If you have a complaint about any part of our service, you can report this by using our feedback form. Please include all details of your transaction and a full description of the complaint. Usually this will be investigated within 2 working days and a reply given within 5 working days via email. However, due to the complexity of some investigations and the number of enquiries received, you accept that it may take up to 20 working days to resolve the complaint.

6 - Customer conduct
If any customer, within any medium of contact with us, uses profanity or demeaning, racial or abusive language of any kind, we reserve the right to terminate the communication, business or sale with that customer and block all future contact without notice. We also reserve the right to pass this information onto the relevant authorities and we will prosecute where necessary.

MrTones reserves all rights to images and text contained within this website. No part of this website may be reproduced without our written consent. "MRTONES" and the MrTones logo are an international trademark in the process of registration.

9 - Website access and browsing
Automated access, browsing and download tools, scripts and utilities, monitoring scripts or utilities and offline browsers and all other programmes other than standard browsing software, including WAP enabled applications, are strictly prohibited from accessing this website, other than those on behalf of recognised search engines and directories . The use of these programs constitutes a breach of contract between you, the visitor and us, the service provider, and we reserve the right to charge for administration, bandwidth and service charges as appropriate.
